These Terms of Sale apply to every order placed through this website. By placing an order you agree to these terms. Please also read our Returns & Refunds Policy, Delivery Policy, Allergen & Product Information page and Privacy Policy, which form part of the contract between us.
2. Definitions
“We”, “us” and “our” mean HERITAGE GLOBAL FOODS LTD trading as Heritage Grocer. “You” means the customer placing an order as a consumer. “Goods” means the food and grocery products listed on this website. “Perishable Goods” means goods liable to deteriorate or expire rapidly, including fresh fruit, vegetables, salad and herbs. “Ambient Goods” means shelf-stable pantry goods that are not Perishable Goods. “Order Confirmation” means the email we send accepting your order, at which point a contract is formed.
3. The contract between us
Orders placed through this website are distance contracts governed by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015. Displaying goods on this website is an invitation to treat, not an offer. Your order is an offer to buy. A contract is formed only when we send the Order Confirmation. We may decline an order — for example where goods are unavailable, where a pricing error has occurred, or where the delivery address is outside our delivery area.
4. Placing an order
You add goods to your basket, proceed to checkout, enter your delivery and payment details, and submit the order. Before submitting you will be shown the total price including any delivery charge. After submitting you will receive an order acknowledgement, followed by the Order Confirmation once payment is authorised and your delivery address is verified as within our delivery area.
5. Prices and payment
All prices are shown in pounds sterling and include any applicable taxes. Delivery charges, if any, are shown at checkout before you pay. Payment is taken at the time of ordering through our secure card payment provider. If we discover a genuine pricing error before dispatch we will contact you to confirm or cancel the order at the correct price; if we cannot reach you, the order will be cancelled and refunded in full.
6. Catch-weight and variable-weight goods
Some fresh goods may be sold by approximate weight. The weight band you select at checkout is the minimum weight we will supply for that price. Where an item is naturally variable, the actual item delivered may weigh slightly more than the stated band at no extra charge. Details are set out on the Allergen & Product Information page.
7. Delivery
We deliver using our own temperature-controlled vehicles within our Swindon delivery area only, as set out in the Delivery Policy. Risk in the goods passes to you on delivery. Ownership passes when we receive payment in full. Because our goods include chilled and perishable items, you or someone authorised by you should be available to receive the delivery; the Delivery Policy explains what happens if nobody is available.
8. Cancellations, returns and refunds
Your cancellation and refund rights differ between Perishable Goods and Ambient Goods. In summary: Perishable Goods are exempt from the 14-day cancellation right under regulation 28(3) of the Consumer Contracts Regulations 2013, but are covered by our freshness promise; Ambient Goods carry the full 14-day cancellation right; and all goods are covered by your statutory rights under the Consumer Rights Act 2015 if they are faulty, not as described, or unfit for purpose. 9. Allergens and product information
Allergen information for the goods we sell is provided on each product page and summarised on the Allergen & Product Information page in accordance with the Food Information Regulations 2014. If you have a food allergy or intolerance, please review the product page before ordering and contact us before purchase if anything is unclear.
10. Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited or excluded by law, including your statutory rights under the Consumer Rights Act 2015. We are not liable for losses that were not foreseeable to both parties when the contract was formed, or for losses connected to a business use of the goods.
11. Complaints and general terms

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction (if you live in Scotland or Northern Ireland you may also bring proceedings there). If any part of these terms is found unenforceable, the remainder continues in force. These terms were last updated in July 2026.
